Michael New goes to Supreme Court

(District of Columbia) -- Attorneys for Army Spc. Michael New will submit a Petition of Certiorari to the Supreme Court on September 10, a move which may well "exhaust the military remedy," as they were instructed by civilian courts in late 1995.  Only one issue is allowed to be brought to the attention of the Supreme Court in this case -- that of whether a soldier accused of disobeying an order has the right to introduce evidence which might prove the order was unlawful.  All other issues remain unresolved, and may not be discussed in the courts until this issue is answered one way or the other.

After the petition is filed, any other attorney or organization interested in filing an amicus curiae ("friend of the court") brief, should contact us.  "Friends of the Court" may bring other issues before the court.  "Friends of the Court" may not be paid.  "Friends of the Court" may even be enemies of Spc. Michael New, but may see an issue which is of burning importance to them.  And there are lots of issues which virtually beg for a "Friend of the Court:"

If you know someone who (a) has the standing to file an amicus brief, and (b) cares about one or more of those issues, then we need to talk.  The deadline for filing an amicus curiae will be 10 October (Michael New Day! - the sixth anniversary of Spc. New's historic walk to that illegal formation in Schweinfurt, Germany, wearing an authorized Battle Dress Uniform).  They do not have to agree with Mike's reasons for his actions.  In fact, it would be good if at least one doesn't.

The Supreme Court will have two options.  First, they may refuse to grant the petition.  If so, then "military remedy" will have been exhausted, and that is good for us.  Second, they may grant the petition and hear the case.  This could be good, or bad, depending on what they do next.  Their options would then include vacating (nullifying) the original court-martial; remanding the case back for a new trial (but not too likely); ruling in Spc. New's favor; and probably one or two we've not thought of yet. 

This is simply to keep you informed of developments in the case.

PS.  Do you want an ACTION ITEM?  President Bush could address this issue directly by revoking PDD 25, the illegal, classified, and very unconstitutional executive order issued by President Clinton.  But he has not done so, probably because he does not know that the American People care about it.  Perhaps this is a good time to ask him to revoke PDD 25.  (For the public version, see http://www.mikenew.com/pdd25.html)  We don't really expect Mr. Bush to embrace Spc.
